Judgment Enforcement & Execution Proceedings
Our practice includes judgment enforcement and execution proceedings through lawful execution mechanisms such as attachment and sale of movable and immovable property, garnishee proceedings, notices to show cause, committal proceedings where legally permissible, appointment of receivers, and other recognised modes of execution to maximise recovery.
Realisation & Enforcement of Securities
We advise lenders on the realisation and enforcement of securities, including legal charges, further charges, debentures, guarantees and other security instruments, guiding them through statutory notices, appointment of valuers, exercise of the statutory power of sale, appointment of receivers or managers where applicable, and lawful realisation of secured assets in compliance with the Land Act, the Land Registration Act and other applicable legislation.
Enforcement of Charges Over Land & Collateral
We also act for banks and secured lenders in enforcing legal charges over land and other collateral upon default by chargors, advising on the perfection of securities, reviewing security documentation, ensuring compliance with statutory procedures, and representing clients in disputes arising from charged property, securities enforcement and recovery proceedings.
Negotiated Settlements & Loan Restructuring
In addition, we assist creditors and borrowers in negotiating repayment arrangements, restructuring loan facilities and formulating commercially viable settlement agreements that maximise recovery while preserving valuable business relationships where appropriate.
